Asia Future Trading Corporation Limited, New Zealand (hereinafter referred to as "AFT") is committed to protecting your privacy online or otherwise, and the success of our business depends on maintaining our customers' trust. This privacy policy is intended to provide a summary of the types of personal information we collect from our customers, how we use, transmit/disclose, and store this information. This policy does not include any third-party websites that can be accessed via links provided on our website.

(A) Data Collection

Generally, two types of information are collected from customers and website users:

  • Personal information, including but not limited to customer name, address, identification and/or passport number, date of birth, email address, employment details, financial status information, investment experience (collectively referred to as 'Personal Information'); and
  • Traffic pattern information related to our website users.

Personal information is collected when customers apply for an AFT trading account (including a demo account) and during any communication with AFT representatives throughout the process. AFT will limit the personal information collected to what is necessary to provide you with the products and services you require.

AFT may also collect other information from time to time, such as through customer surveys used for research and feedback purposes, to continuously improve the quality of the services and products we offer. Personal information collected online may be combined with other information provided to AFT by the customer via physical copies or other sources and may also be collected indirectly through monitoring or other means, such as recording phone calls and monitoring emails. In these instances, AFT will not review information continuously or routinely, but it may be used for compliance or security purposes.

Traffic pattern information includes details about the web pages users visit, the number of users frequently using our website and/or trading platforms, etc. This information is anonymous and can only be used in aggregate form. We also collect information via 'Cookies,' which will be further explained below.

(B) Purposes for Collecting, Processing, and Disclosing Personal Data

Collection

Generally, the purposes for collecting personal data and aggregated data include:

  • Providing our products and/or services to customers, which may include:
    • Executing or managing any transactions requested and/or authorized by customers;
    • Maintaining, servicing, and/or terminating customer accounts;
  • Enhancing website content and user experience, and notifying customers of any enhancements/upgrades/updates.
  • Disseminating/distributing information for marketing purposes about products and/or services that are similar or related to those provided to the customer. (Customers can always opt-out of receiving such information by contacting us or using the unsubscribe feature.)
  • For legal and compliance reasons, in accordance with applicable laws, including:
    • Due diligence procedures for account opening and ongoing monitoring;
    • Compliance with internal risk management procedures, other supervision, and compliance procedures for audit/financial accounting and management reporting purposes;
      • Processing bank withdrawals and/or deposits;
      • Exercising legal rights;
  • Disclosing information to law enforcement agencies and other relevant authorities for the prevention and detection of crime;

Processing and Disclosure

AFT may share, process, and disclose personal information in the following circumstances:

  • Disclosure of information to our parent company and/or group companies that are permitted to use, process, and/or disclose personal information for effective commercial or legal purposes, including:
    • Executing or managing any transactions requested and/or authorized by customers;
    • Maintaining, servicing, and/or terminating customer accounts;
  • Disclosing information to business partners or third-party service providers as necessary, bound by confidentiality agreements unless otherwise permitted by law - this may include verifying your identity and authenticity of documents provided through relevant government agencies, credit reporting agencies, and/or any other institutions;
  • Disclosing information to AFT's legal advisors, accountants, auditors, and any other professional consultants;
  • Disclosing information to legal/beneficiaries in customer accounts, including individuals acting as trustees, authorized representatives, and/or in a legal capacity;
  • Disclosing information to government, regulatory, and/or law enforcement agencies to comply with legal requirements and/or any applicable laws (including the prevention of fraud, unlawful or illicit transactions, claims, or liabilities) and to assist with any legal and/or regulatory investigations.

Please note that AFT may also share and/or disclose non-personal and non-identifiable information with third-party service providers for business purposes in an aggregated or anonymous form.

AFT will not share, process, or disclose personal information for marketing purposes to business partners or third-party service providers.

(C) Overseas Transfer of Personal Information

If AFT needs to transfer personal information outside of New Zealand (e.g., for data storage, data management, and/or consolidation purposes), whether to parent companies, group companies, business partners, or third-party service providers, or simply to transfer data to storage facilities, AFT will comply with the Privacy Act and ensure that the standards for personal data protection are comparable to those provided under the Privacy Act.

(D) Consent

AFT (including its employees, directors, and/or representatives) must maintain strict confidentiality of personal information, as required by law, and will not disclose any personal information without your prior consent, except as provided in this privacy policy, unless otherwise required by law.

Generally, when AFT requests personal information to provide you with services and/or products, and you provide such personal information to us, it implies your consent to provide your personal information to enable the provision of the requested services and/or products.

In certain circumstances and as required by applicable laws, we will seek your explicit consent at the time of collecting your personal information, particularly for new purposes that require new consent to use your personal information.

By providing us with personal information related to third parties (e.g., but not limited to, information about your spouse, children, and/or parents), you declare and warrant that you have obtained the third party's consent to collect, use, and/or disclose the personal information as listed herein.

You may withdraw your consent at any time by contacting us. However, please note that if you withdraw your consent for any or all purposes set out in this privacy policy, depending on the nature of your withdrawal request, it may (substantially or otherwise) affect the way AFT can provide services and/or products to you.

(E) Retention

Personal information will be retained for as long as necessary to fulfill the purposes for which it was collected or as required or permitted by applicable laws. Once AFT has a reason to believe that the purpose for which personal information was collected is no longer valid and that it is no longer necessary to retain such personal information, AFT will cease to retain or delete the personal information associated with specific customers for legal or commercial purposes.

(F) Accuracy and Correction

AFT strives to ensure that your personal information is as accurate and up-to-date as possible. We typically send reminders to customers each year to notify us of any changes to their personal or business information. However, if you wish to correct, modify, or update your personal or business information (for our corporate clients), you are welcome to contact us at any time. (G) Access Rights

You also have certain access rights to your personal information. Please fill out this form form to contact us and make a request; your request will be acknowledged and acted upon within thirty days. If we are unable to fulfill your request for any reason, you will be notified accordingly.

Please note that AFT reserves the right to charge a reasonable administrative fee for this service, and you will be informed of the fee before we take action on your request.

(H) Security Measures

AFT has implemented various security procedures, technical, and organizational measures to protect your personal information. To prevent external attacks, we employ robust firewalls and security measures to detect, isolate, and prevent hacking and other malicious software from infiltrating our computer systems.

AFT employees also participate in regular security awareness programs to raise information security awareness, enabling them to identify and appropriately respond to security risks.

We will make every reasonable effort to protect your personal information. However, the use of the internet is not entirely secure, and we cannot guarantee the security or integrity of any personal information transmitted from you or to you via the internet. Please note that you are responsible for ensuring the confidentiality and security of your access credentials at all times.

(I) Updates to Privacy Policy

This privacy policy may be amended at any time or as necessary and shall take effect from the time it is published on this website. Continued use of our website will be considered acceptance of the updated privacy policy. However, before collecting further personal information or before using or disclosing your personal information for new purposes, we will seek your consent.

(K) EU General Data Protection Regulation (EU GDPR)

In addition to obligations under the Privacy Act, AFT complies with the obligations under the EU GDPR concerning EU individuals. If the EU GDPR requires higher protection for the personal data of EU individuals than the Privacy Act, this stricter requirement shall be followed.

Under Article 27 of the EU GDPR, AFT has designated Asia Future Trading A/S as our representative in the EU.

(L) Governing Law

This privacy policy is drafted solely in accordance with New Zealand law. We make no representations or warranties that this privacy policy complies with the privacy laws of any other jurisdiction, and you should not interpret this privacy policy as such.

In the event of any discrepancies between the English and Chinese versions of this document, the English version shall prevail.
